The Times of India reported "The Supreme Court dealt a cruel blow to lakhs of homosexuals........." and consequent to the SC judgment the Government of India decided to appeal for revision. As a matter of fact, there was no reason for that community to be joyful earlier. On July 2, 2009, the Delhi HC division bench had declared "Section 377 IPC, insofar it criminalizes consensual is volatile of Articles 21 (right to life), 14 (right to equality), and 15 (grounds of sex and gender) of the Constitution and that passed the judgment that IPC 377 is counter to constitutional values. The Right Hon'ble Government of India represented by Law Ministry proudly declared that it would not challenge the HC judgment but did not bother change IPC 377 by an Act of Parliament. Of course many Hindu, Muslim and Christian groups challenged the HC judgment and hence the SC judgment. Unless and until the prevalent law is changed, it prevails. LGBT community had nothing to celebrate as GOI did not do anything to change the Law. When the SC ruling came the wise at TOI had no hesitation to say it was a cruel blow, when the SC merely said that the observation of HC that IPC 377 did not go against the Spirit of Constitution expressed in Articles 14, 15, 19 and 21 and also that "Notwithstanding this verdict, the competent legislature shall be free to consider the desirability and propriety of deleting Section 377 IPC from the statute book or amen d the same as per the suggestion made by the Attorney General". I will not go through details how SC decided that IPC 377 was not against Articles 14, 15, 19 and 21 of Indian Constitution, as it would be more elaborate and not of interest to a common person. Same-sex marriage is legally recognized nationwide in Argentina, Belgium, Brazil, Canada, Denmark, France, Iceland, the Netherlands, New Zealand, Norway, Portugal, South Africa, Spain, Sweden and Uruguay. In the United States, same-sex marriages are recognized on the federal level, though same-sex couples can only marry in eighteen of the fifty states. In Mexico, same-sex marriages are only performed regularly in Mexico City and Quintana Roo, but these marriages are recognized by all Mexican states and by the Mexican federal government. Israel does not recognize same-sex marriages performed on its territory but recognizes same-sex marriages performed in foreign jurisdictions. Israel is a secular country, it is not a Christian country like US or UK and so it is paradox like another secular country, India.
Indian Penal Code came into being on 6th October, 1860 by Article 45 of Parliament when British were the kings of the country. The British were thrown out but not the law books. When India adopted its own constitution, it could have done so. It was not an easy job, after due study of Irish, British and American constitutions, our constitution was drawn up. While doing so, the makers found that IPC need not have to be changed. Some say, the IPC is age old law. Mosses, John the Baptist, Jesus Christ are older than the constitution. "Thy should not commit stealing and adultery" said Moses. Does this law require a change, because it is more than 2000 years old?
IPC 377: Unnatural Offences: Whoever voluntarily has carnal xxxxxxxxxxx against the order of the nature with any man, woman or animal, shall be punished with imprisonment for life or with imprisonment of either description for a term, which may extent to 10 years, and shall also be liable to fine" Some learned psychologists and doctors argue, human autonomy is such that he/she/it can have xxx in any manner. Nature does not get confused as these doctors do, all the muscles and orifices are for specific purposes. Some years ago a man climbed all the steps to Birla Mandir on his hands. The same doctors would say, he/she/it is capable of doing so. But my friend, hands and legs are evolved for specific purposes and are efficient. There is no need to do what I do with my legs, using hands. If you walk on hands instead of legs, it is unnatural and this is the spirit of IPC 377. If the offence is committed involuntary (like lunacy), it is not punishable. US Psychologists' association declared that 40 years ago that homosexuality is not a disease. Not to be left behind, Indian Psychologists had the same opinion last month. So, homosexuality is not by chance but by voluntary choice, which is punishable up to life imprisonment under IPC 377.
There is an orphanage managed by Mr. Constitution which has one lakh orphans. One boy has a very rare disease and it costs a huge amount for treatment. Mr. Constitution does not forsake his responsibility as it is not by choice the boy is in such a situation considering Articles, 14, 15, 19 and 21. There is another boy who wares his shoes on head. Mr. Constitution consulted the psychologists first to ascertain whether this boy also suffers 'one in a million disease'. He did not, said the psychologists. Mr. Constitution called the boy and reprimanded, "You are what you are by choice, you better fall in line with others. There is no point in wearing shoes on your head" and denied all provisions of Articles 14, 15, 19 and 21. Head Clerk [assistant to Senior Clerk], looked out of the window towards Australia and all Americas and raised the objection - 'shoe over head' should be treated at par with others and there should be no exploitation of such people by lathi boys. HC said, "They are harmless, not terrorists nor bomb makers. Mr. Constitution should not interfere." Outside some activists yelled, "Majority should also protect the minor-minor-minor minority population of 'shoe over head's. But the Senior Clerk looked at the history of the institution said, " 'shoe over head's are against the dignity of humans though they are not subversive and so they will not get any provisions under 14, 15, 19 and 21. Mr. Constitution is a humble manager, while People is the owner of the institution. Some people who represented People in various capacities were just passing by, very fast - in five months they may be with the People or out. They said the 'shoe over head's should get full measure of rights, equality etc. as SC clearly has said, "Notwithstanding this verdict, the competent legislature shall be free to consider the desirability and propriety of deleting Section 377 IPC from the statute book or amend the same as per the suggestion made by the Attorney General".
I am not a terrorist nor do I indulge in any anti-social, anti-national, anti-sonic (not against sound pollution caused by politicians). My guruji is about to pass away in six months. Being a great devotee, I want to exhume his body after decay so that I can keep his holly skeleton in my bedroom. As you observe from the world map, the countries in Americas and Australia are becoming more liberal and Europe is awakening to the new wave while the countries in Asia and Africa are not. What is the bondage in a conventional marriage (or in mammals)? It is the common interest in the offspring -born out of them. Earlier plants had asexual method of reproduction and now we have male and female flowers. When the present bacteria come across ancient broken DNA structures which are dormant, say in Amazon riverbed, new bacteria are born. By sexual reproduction, the immunity of gained by both the partners is passed on to next generation. Homosexual marriage is not reproductive, they have to depend on a female and artificial insemination. That means the responsibility of continuance of homosapien species depends on existing and diminishing hetero sexual population. First they have to increase their fertility power by minimum 13% and like our dairy cows should start producing babies by liters, kgs and meters! Mark my words - democracy means head count. It does not matter whether I am of A religion or B religion, christian, orthodox, ultra modern, rich or poor. Imagine I have found yet another religion and I have many heads aged above 18 in my followers, then I can form the government and my religion and culture will be in prominence, if I do not dictate terms to others, even in a secular set up. There will be imbalance between Modern, liberal world and conventional world of Africa and Middle East. The imbalance in the population will cause religious and cultural conflicts, though both the worlds belong to Abhramic religion. Population is the reason why Ligayats and Okkaligas are prominent ministers in Karnataka and not Brahmins, Jains or Muslims!
In its affidavit before SC, the Government declared, there are 2.5 million belong to LGBT in the country [0.001968504% total population of 1.270272105 billion]. For argument's sake, considering that there are equal number of such persons who are scared to come open [though such practices were prevalent in ancient India], the percentage of gays and lesbians will be infinitesimally small 0.003937008% to be precisely! When the Supreme Court gave the judgment, Indian Government was also ashamed. Law Ministry is very innocent of the Law, merely not appealing against HC judgment does not repel IPC 377. They should have taken up this cause along with Right to Food, Right to Water and Right to Air. 50% of the current population is in its primes (up to 25 years) while remaining 50% tread towards non reproductive age and disappear in few years. If the remaining 50% are subjected to liberal laws of western world ignoring the native culture, in a life time India would be a Western country in the East! When the male: female ration is 100:94, we are seeing rampant rape, gang rape and advertisements bordering on indecency. Suppose this same-sex married population goes up due to recognition of government, there will be drastic consequences due to imbalance in male : female ratio.
One of my learned clients (he belongs to this group) said, homo sexuality was prevalent in ancient India. Homosexual relationships existed in ancient Greece, in Japan and in Africa. Many erotic sculptures are found in the temple premises. By this the devotees are being exhorted to leave these sexual thoughts aside before they enter inside the temple. In many purans this is used to describe the 'koutuka' rasa as in Arabian Nights. A purana is supposed to have all the rasas (nava rasa) so that the poet can capture the minds of his audience. This gives impression that such relationship were seen (prevalent is not the word) in ancient India. If you chance on Times of India edition dated 13.12.2013 after 100 years, you will get the same impression! Similarly, an imaginary creature called shardula is also sculpted in temples. Should we say that shardula was also more prevalent in ancient India along with gays and lesbians? This has become a burning issue now, in same progression backwards, this could have been burning issue in earlier times -17th, 16th, 15th or 4th century. Have you comes across any mention of such conflicts in times of Shankaracharya, Vyasa, Viswamithra, Jesus and others? Like today, it could have been a minor population. It is argued that Manusmruti mentions punishments for such unnatural offences to prove these practices were prevalent. Note that they were offences in those days also! Eight types marriages are described in Manusmruti - Brahma, Diava, Arsha, Prajapatya, Asura, Gandharva, Rakshasa and Pishaca while same-sex marriage is not recognized.
Shri Dubgaye is a popular columnist and an NRI who belongs to this minority group. His mature parents warned him before he came to India but he was courageous. Vs Naz Foundation & Ors. dated 11 December, 2013].
HC in its judgment dated July 2, 2009 had observed - "morality is not a basis to override fundamental rights". On the contrary, a secular country is not a country devoid of any moral values. Morality is the foundation of all the religions of the world. Morality should be the basis of all Rights and Duties of its populace. No matter whether the type of government is democracy, socialism or any other, guidelines for governance should be अहिंसó(nonviolence), अद्वेष (non-prejudice), मैत्रि (friendship), करुण (compassion), मुदित (happiness), समदृष्ठि (equality) and लोकसंग्रह (welfare of the entire society and world). Is there any directive in religious scriptures that the ozone layer should be protected? By seeing the consequences of what would happen after say, 200 or 500 years, the world is initiating projects to restrict the damage. This लोकसंग्रह buddhi should be applied by the government, before they make any law. The Government should think where the society would head if the IPC 377 is dropped or amended. The relationship with man and wife is more firm as they have a common off spring and it is not so in case of same sex marriage. After 75 years the divorce rate in same-sex marriages may also rise- due to economic independency and men travel far and wide. An ultra modern group within same-sex group in Brazil (the second largest cattle country) may find marriage between man/ woman and a domestic animal is a solution, for this problem. The animals do not have economic independence. That group may argue, " We rear some animals for wool, some for milk, some for meat and then why not some for pleasure. If we do not look after the animal properly let we be punished ". Surely some Indians will be in Brazil and like today, India could be the first largest cattle country in future also! What if, after 275 years yet another ultra ultra modern modern group within this group finds that cucumbers, papaya and water melons are better options and they are not objected by animal activists? Let Western world care about ozone layer depletion and let India take care of moral depletion.
Now, let us have a look, astrologically of the days to come. There was an young man, an auditor (the minimum cadre other than peons) in Defence Accounts Department, Mumbai. On 09.12.2012 when same-sex law was passed in Washington, Uranus was in the 8th house and Neptune in 7th while Pluto was in 5th. When the law was passed in Quebec, Pluto was in ascendant, Saturn in 8th. When the law was passed in California on 28.06.2013, Neptune was in lagna. In Iowa on 24.04.2009, Pluto was in 2nd, Neptune in 4th and Uranus was in 5th. In Indian foundation chart from 2008 to 2020, Pluto transits in 8th. There is rapt conjunction of shani and Pluto in 8th from lagna of foundation chart, during late 2019 to early 2020, when same sex marriage will be recognized. There is guru in own sign also which means there is not stiff resistance but resigned attitude. The fight is not done with full commitment and like Semaikyandhra moment it will die prematurely. Perhaps there is another infighting in BJP between Modies and Advanis. Or the people think that womenfolk will be safe, if all boys are busy with themselves or with other boys! The girls will be held to be normal still, the enactment of Law does not effect the girls much. Law makers can make laws but laws are not alive. Right to Food does not feed unless people want to eat. If government gives rotten rotti, people will through the rulers to dogs. People of Pune, Delhi, Mumbai and other places in India will have the same attitude they had towards Acharya graduated to Bhagwan. Society continues same way - Hindu, Muslim and Christian, Jain, Buddhist and what not! Mahabharat Matrimony will continue to exist in the present day form; purohits and caterers will be still busy and while astrologers consult the matching table for boy's star and girl's star. There will be bahu and tears in the eyes of the mother, when the beloved daughter departs, not to forget cradle ceremony and babynames.com!
